Terms & Conditions

Introduction and Definitions:

Hack4AI and other events are hackathon events, competitions, and forum activities that bring together developers, designers, and entrepreneurs organized by Helve.

 

In these Terms and Conditions ("Agreement"), "Hack4AI" refers to Hack4AI as defined on the website hack4.ai, where Participants apply to participate, purchase a ticket, or otherwise register for specific Hack4AI or other events organized by Hack4AI.

 

In this Agreement, "Event" refers to Hack4AI and other events organized by Hack4AI where Participants apply for participation, purchase tickets, or otherwise register.

 

In this Agreement, "Hack4AI website(s)" refers to websites owned or managed by Helve: webpage, Devpost, as well as to online services, such as a platform where there may be application forms, project submission, and other services related to the Event provided by Hack4AI on these websites.

 

In this Agreement, "Account" refers to the individual user account of the Event's applicant or participant. The applicant or participant's Event application form is located in the Account. The respective applicant or participant can change the information provided in the application form in the Account. Event participants can also provide additional information to Event organizers, find a hackathon team, submit a project, and use other services related to the Event.

 

Participants agree to abide by this Agreement when applying for participation, purchasing a ticket, or otherwise registering for the Event on the Hack4AI website. To avoid any doubt, a person who has been accepted to purchase a ticket or otherwise registered for the Event is considered as participating in the Event.

 

This Agreement is a binding legal contract between the Participant, i.e., the Event application submitter or participant or any user of the Hack4AI website ("Participant") and Hack4AI.

 

If Participants have any questions about this Agreement, they can contact us by email at hq@helve.eu.

 

Hack4AI may modify this Agreement; such changes become effective when Helve publishes them on the Hack4AI websites. It is the Participant's responsibility to periodically check this Agreement for changes. By continuing to participate in the Event and continuing to use the Hack4AI websites after the publication of changes, the Participant confirms that he accepts and agrees to the changes. Furthermore, Participants may read this Agreement provided by a third-party service; in this case, the version of the Agreement may be outdated, to ensure always finding the latest version on the Hack4AI websites.

 

Applying for the Event

Participants can apply for the Event by filling out an application form on the website link during the specified application period. By applying to participate in the Event, participants provide accurate and complete registration and other information as required by Hack4AI.

 

Participants must make all reasonable efforts to prevent unauthorized access to or use of their account. If a participant suspects any unauthorized access to or use of their account, they must immediately inform Hack4AI.

 

Usage Restrictions

A participant with an account is not permitted and does not have the right to engage in any of the following actions:

  • Register an account in another person's name;

  • Use the account to transmit any unauthorized advertisements, promotional materials, junk mail, spam, chain letters, contests, pyramid schemes, or any other form of solicitation or mass messaging;

  • Use the account in violation of applicable laws;

  • Use the account in ways that infringe intellectual property rights, trade secrets, or the privacy of third parties;

  • Use the account to transmit any material that contains adware, malware, spyware, software viruses, worms, or any other computer code intended to disrupt, destroy, or limit the functionality of computer software or hardware.


 

Participation in the Event: 

Regarding the participant's involvement in the Event, the participant is required to provide accurate and complete information to Hack4AI as requested.

 

Hack4AI reserves the right to request applications and determine the participants for each Event among applicants at its discretion. Such decisions by Hack4AI are final and not subject to appeal. For clarity, Hack4AI also reserves the right to accept previously rejected applicants for participation in the Event at its discretion, notifying such applicants accordingly.

 

Hack4AI may provide technical challenges and resources/materials for Event participants to work with.

 

A team selected by Hack4AI may choose the winner or winners from the work products created and developed by the participants in the Event ("Submission"). The selection of the Event winner(s) is always final and not subject to appeal. If a participant accepts a prize for winning in the Event, they are fully responsible for all applicable taxes related to receiving the prize.

 

Hack4AI reserves the right to disqualify a participant from the Event at any time at its sole discretion, for reasons such as improper behavior during the Event, violation of Event rules or this Agreement, or according to Hack4AI's wish. Hack4AI has the right to cancel or suspend the Event for any reason or no reason at all. Hack4AI is not responsible for any damage or inconvenience resulting from the cancellation or suspension of the Event or participant disqualification.

 

Hack4AI may set different prices for tickets to the Event. More information about participant eligibility, challenges, resources, pricing, rules, venue, Event organizers, volunteering, partnerships, and the event schedule can be found on the relevant Hack4AI website.

 

By participating in the Event, the participant must adhere to the following rules:

  • The participant must comply with this Agreement and all additional rules set by Hack4AI at the start of the Event;

  • The participant's submission must not contain viruses, Trojan horses, worms, malicious code, or any other harmful or destructive element;

  • The participant's submission must not include content that violates any law or third-party rights (including privacy and intellectual property rights), unless the participant owns such rights or has permission or a license to use such content in their submission for the Event under this Agreement;

  • The participant must upload the information of their submission to their account or a third-party service. This information includes, for example, the submission's title and description, slogan, descriptive media content, a link to the submission's source code and its trace, and the challenge in which the participant participated in the Event. Information about the participant's submission can be uploaded to a third-party service. In this case, see the specific rules of the Event for information on publishing the participant's submission.


 

Participant Content on Hack4AI Website

Participants are entirely responsible for all content they may upload/transfer to Hack4AI websites, including Submissions. Hack4AI has the right, but not the obligation, to monitor Submissions to ensure compliance with the Agreement. If Hack4AI, at its sole discretion, determines any Submission violates this Agreement, intellectual property rights, or applicable laws, Hack4AI has the right to delete such Submission.

 

Hack4AI disclaims any responsibility for duplicating and/or storing Submitted content. The Hack4AI website must not be used to duplicate participant content.

 

Participants agree that Hack4AI assumes no responsibility or liability for participant content. Participants ensure their Submission does not infringe any third-party rights or applicable laws. Furthermore, Submission content must not be offensive, threatening, defamatory, slanderous, or inappropriate. For clarity, Hack4AI is not responsible and does not assume any liability for participant content, nor does it endorse any views included in a Submission.

 

Hack4AI has the right to generate anonymous user and statistical data from Submissions, retaining all rights to such anonymized data.

 

Intellectual Property Rights

All Submissions and other works made during the Event remain the intellectual property of the individuals or legal entities that created them. Hack4AI does not claim any intellectual property developed during the Event, unless specified otherwise. However, by participating, participants grant Hack4AI and its business partners a worldwide, perpetual, irrevocable, sublicensable, and non-exclusive license to use information related to the Submission for advertising and marketing purposes. Participants understand they will not receive any compensation for the use of their content by Hack4AI.

 

By participating in the Event, participants acknowledge that the Event may be recorded for reference and similar use. Therefore, participants grant Hack4AI a broad, continuous, irrevocable, sublicensable, and non-exclusive license to depict the participant's work from the Event for advertising and marketing needs, with no compensation for the use of their work.

 

Hack4AI owns and retains all intellectual property rights to Hack4AI websites. The Hack4AI name and logo are owned by Hack4AI and cannot be used without permission. Nothing in this Agreement is considered a transfer of intellectual property rights or other rights of Hack4AI to the participant.

 

Publicity

By attending the Event, the participant consents to being filmed and/or photographed at the Event. Moreover, the participant agrees to the publication of such material on Hack4AI's and/or, where applicable, third-party marketing and communication channels without the participant's review, approval, or compensation at any time.

 

Confidentiality

In the context of participating in or applying to the Event, participants may be exposed to Hack4AI's confidential information, such as confidential and/or patented knowledge, know-how, data, or business-related information, regardless of whether it is marked or identified as confidential or patented ("Confidential Information"), including inventions and research and development results, services and marketing plans, source code, object code, client and supplier and other third-party information, business plans, budgets, financial information, pricing, and costs.

 

Participants agree to keep Confidential Information secure and not disclose it to any third party during and after the Event. Participants agree to use Confidential Information only for the duration of the Event and to comply with all Hack4AI policies.

 

Personal Data

Hack4AI collects and processes data, including personal data related to the participant's registration or applications on the Hack4AI Website, applications, or participation in the Event, such as the participant's contact information, other identification data, and information related to Submissions. To the extent Hack4AI is considered the data controller of such personal data under applicable laws, Hack4AI informs data subjects about its processing practices in the Hack4AI Privacy Policy and processes such personal data in accordance with its Privacy Policy from time to time. The Hack4AI Privacy Policy can be found on the relevant Hack4AI website.

 

Term

This Agreement remains in full force while the participant is a user of the Hack4AI website or participates in the Event. The terms of this Agreement intended to survive the termination or expiry of this Agreement remain in effect.

 

Obligations

Hack4AI will endeavor to ensure the Hack4AI websites function properly. However, technical difficulties or maintenance may occasionally cause temporary interruptions.

 

Hack4AI will strive to ensure the Event runs smoothly. Hack4AI reserves the right to change the content, timing, date, and/or location of the Event without liability to the participant, provided the modified Event substantially resembles the initially advertised Event. Hack4AI also reserves the right to cancel the Event at any time, in which case participants will receive a full refund of any fees paid according to this information.

 

Hack4AI reserves the right to modify or discontinue, temporarily or permanently, the features and functionalities of the Hack4AI websites at any time and periodically.

 

To the extent permitted by applicable law, Hack4AI shall not be liable to the participant or any third party for any indirect, consequential, or punitive damages arising from applying for or participating in the Event, or from using Hack4AI websites, or for any direct damages exceeding the amounts Hack4AI has collected from the participant.

 

This Agreement's parties do not limit their liability for matters where it is not permitted to limit liability under mandatory laws (e.g., consumer protection laws).

 

Governing Law and Disputes

This Agreement shall be governed and interpreted in accordance with the laws of the country where the Event takes place, without reference to its conflict of law provisions. All disputes shall be adjudicated in the court of first instance at the legal address of SIA Helve.

 

Miscellaneous

This Agreement applies only to the use of Hack4AI websites (and events). Services and platforms provided by third parties are governed by their terms of use or other agreements or licenses. Hack4AI is not responsible for the use of such third-party services and platforms, whether or not they are linked to Hack4AI websites.

 

The content on Hack4AI websites, including but not limited to text, graphics, images, links, and other materials, is for informational purposes only. Hack4AI does not endorse or recommend any specific software or other information mentioned on its websites. Reliance on any information provided by Hack4AI websites is solely at the user's own risk.

 

If any provision of this Agreement is invalid, the remainder remains in full effect. This Agreement does not create an agency, partnership, or employment relationship.

 

Participants may not transfer this Agreement to a third party. Hack4AI may transfer this Agreement to its affiliates or successors as part of a corporate reorganization, merger, acquisition, asset sale, or other corporate restructuring.
